Refund and Cancellation Policy
This document is an electronic record generated by a computer system and does not require any physical or digital signatures. This is a legal agreement between you and Cusp (“Company” or “we” or “us” or “our”) and it governs your access to and use of the Cusp platform.
This refund and cancellation policy (“Policy”) is published pursuant to the terms and conditions of Cusp and the terms hereof shall constitute the cancellation and return mechanisms in relation to the services provided by us.
The Cusp platform provides certain in-app purchases on a subscription basis. You understand and acknowledge that the Cusp platform is not a payment gateway, payment processor and/ or a payment service provider, as may be defined or provided for under applicable law. Accordingly, we may engage certain third-party service providers to enable, facilitate and otherwise complete the payments for the said in-app purchases and subscriptions.
Any and all charges for or towards in-app purchases and subscriptions are strictly non-refundable and we do not entertain any non-provisioned refund or cancellation requests. There are accordingly no refunds, in-app credits, account credits, reversals, chargebacks, reimbursements and/ or repayments provided in lieu of any in-app purchase or subscriptions (including for partially used period or periods where in-app subscriptions were made but not utilized).
Amount once paid through the third-party payment gateway shall not be refunded other than strictly in the circumstances where the amount has been charged to a user owning to a technical error, technical bugs, system or network failure, debit of excess amount in a single transaction owing to technical bugs or errors, unsuccessful transactions, or erroneous debits (“Technical Issues”). The Cusp platform accepts no liability for any loss, direct or indirect, that the customer experiences as a result of or attributable to the functionality of any third-party payment systems.
Please note that an in-app purchase or subscription, once issued, cannot be cancelled or refunded. The only eventuality for consideration (and not provision) of a refund would be owning to Technical Issues (which are only encountered at the outset to make the payment towards obtaining a subscription) set out above. If such payment is successful or deemed successful by us on our assessment, there would be no eligibility for any cancellation or refund assessments.
In the event that particular customer wishes to make an application for a refund or a cancellation owing to the Technical Issues set out above, the customer will have to make a written application (emails permitted) for refund / cancellation citing the reason and background regarding the same for our assessment thereof. The customer shall furnish the relevant transaction number, an original payment receipt (including electronically generated receipts), and adequate proof indicating the occurrence of the Technical Issue.

Once submitted, the application will be processed internally and after verification, if the claim is found valid, the disputed amount would be considered for refund, in accordance with and further subject to the refund mechanisms and practices followed by the relevant third-party payment service provider/ gateway. Please note that we provide no guarantee, warranty, promise or assurance for any refunds/ cancellations following our internal review.
Further, the Cusp platform assumes no responsibility and shall incur no liability if it is unable to affect any assessment for an application due to any one or more of the following circumstances:
The user agrees that Cusp, in its sole discretion, and without penalty, reserves the right to suspend or terminate his / her account (or any part thereof or use of the service and remove and discard all or any part of his / her account, user profile, or his/her recipient profile), at any time if Cusp determines that the usage of the platform by the user is suspected, fraudulent, abusive, or for any illegal activity. In such cases, Cusp may also in its sole discretion and at any time, discontinue providing access to the services, or any part thereof, with or without notice and it is clarified that if such user has paid any amounts towards subscription or in-app purchases, he / she will not be eligible for a refund despite pre-mature termination of his / her account.
In no event will Cusp be liable for any damages (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages, damages arising from personal injury/ wrongful death, and damages resulting from lost profits, lost data or business interruption), whether based on warranty, contract, tort, or any other legal theory and whether or not we are advised of the possibility of such damages.
Changes to this Policy
Cusp may update this Policy from time to time. Thus, you are advised to review this page periodically for any changes.
