THIS DOCUMENT IS AN ELECTRONIC RECORD GENERATED BY A COMPUTER SYSTEM AND DOES NOT REQUIRE ANY PHYSICAL OR DIGITAL SIGNATURES. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND CUSP AND IT GOVERNS YOUR ACCESS TO AND USE OF THE CUSP PLATFORM.

These terms and conditions (“Terms”) govern your access to and use of the application and any other online platform (collectively, the Platform) offered by Cusp to provide you with the services. These Terms are to be read in conjunction with the privacy policy.

We are committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

By downloading or using the Cusp app (“app”), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to Cusp. You agree not to reproduce, distribute, sell, modify, display, perform, archive, publish, license, create derivative works from, offer for sale or use (except as expressly authorized under these Terms), or in any way exploit any part of any intellectual property or other information, content, materials, and services available on or through the Services.

You agree not to use any product which modifies, changes, adds to, or subtracts from the source code, graphical user interface, structure, integration, look and feel or features of the Services.

You agree and understand that Cusp reserves the right to suspend, refuse, or restrict your access to Your account and the Services therein in the event that you are found to be in violation of these Terms.

The Cusp app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Cusp app won’t work properly or at all.

We may send you communications including in the form of messages, emails or otherwise and share marketing and or promotional information, one-time passwords (OTP), etc. You hereby acknowledge and consent to receiving such communications. Provided that on deletion or deactivation of your account or the Cusp application, you may choose to opt out of receiving the said communications from Cusp.

The app does use third-party services that declare their Terms and Conditions.

Receiving OTPs for Authentication

By signing up on Cusp, you agree to receive One-Time Passwords (OTPs) for authentication via WhatsApp at your registered phone number.

By continuing to use Cusp, you acknowledge and accept this communication method as part of the authentication process.

Communication & Notifications Update

We may send you communications in the form of (including but not limited to) messages, emails, or other notifications, including one-time passwords (OTP) via WhatsApp. You hereby acknowledge and consent to receiving such communications. If you deactivate or delete your account, you may choose to opt out of receiving such communications from Cusp.

Child Safety & Protection

In order to access the Services and to create and maintain an account you must be at least 18 years of age.

Disclaimer

You are solely responsible for your interactions with other members on the Cusp app. You understand that we do not conduct criminal background checks on its members or otherwise inquire into the background of its members and make no representations or warranties as to the conduct or compatibility of members.

All products, and services are provided to you "as is" without warranty of any kind either express or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy.

The Services may be under constant upgrades, and some functions and features may not be fully operational. Due to the inconsistencies that can occur in the electronic distribution of information and due to the limitations inherent in providing information obtained from multiple sources, there may be delays, omissions, or inaccuracies in the content provided on the platform or delay or errors in functionality of the platform. as a result, we do not represent that the information posted is correct in every case.

We shall not be liable to you or anyone else for any losses or injury arising out of or relating to the information provided on the platform. In no event will we or our employees, affiliates, authors or agents be liable to you or any third party for any decision made or action taken by your reliance on the content contained herein.

In no event will we be liable for any damages (including, without limitation, direct, indirect, incidental, special, consequential or exemplary damages, damages arising from personal injury/wrongful death, and damages resulting from lost profits, lost data or business interruption), whether based on warranty, contract, tort, or any other legal theory and whether or not we are advised of the possibility of such damages.

Miscellaneous

You cannot assign or otherwise transfer the provisions of these Terms, or any rights granted hereunder to any third party. The rights of Cusp under these Terms are freely transferable to any third party without the requirement of seeking your consent

If, for any reason, a court of competent jurisdiction finds any provision of these Terms, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties as reflected by that provision, and the remainder of the Terms shall continue in full force and effect

Cusp shall not be liable to you for its failure to perform or for delay in providing you access to your account or to the Services, to the extent such failure or delay results from causes beyond its reasonable control, including, without limitation, acts of God, fires, explosions, wars or other hostilities, insurrections, revolutions, strikes, labour unrest, earthquakes, floods, pandemic, epidemics or regulatory or quarantine restrictions, unforeseeable governmental restrictions or controls or a failure by a third party hosting provider or internet service provider or on account of any change or defect in the software and/or hardware of your computer system.

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
